The foundations for our firm’s recognition as a pre-eminent German practise for insolvency, turnaround and restructuring were laid by senior partner Dr. Jobst Wellensiek and his year long partners.
Today, Wellensiek Rechtsanwälte Partnerschaftsgesellschaft specialises in dealing with all issues arising in situations of corporate insolvency or where companies are financially troubled. Based on our experience from hundreds of successful insolvency administrations and turnarounds, among them many of Germany’s highest profile and widely publicised insolvencies, our specialised partners are able to influence the development of things at a stage where matters can still be improved i.e. where formal insolvency proceedings can still be prevented through out-of-court restructuring. Where such out-of-court restructuring is not feasible, our focus is on preparing the optimum restructuring in the context of formal insolvency proceedings.
Where our firm is not conflicted because we advised in the run-up to formal insolvency proceedings, our specialised partners are frequently appointed as liquidators for the administration of an insolvent business by the competent insolvency courts. Where we act as liquidators, the restructuring of the insolvent business wherever prudent remains our focus.
Besides administering corporate insolvencies, our major practice area is to advise and represent shareholders, management and stakeholders in situations where companies are financially troubled or go through formal insolvency proceedings and where we advise on all legal issues that arise from such situations. Over the preceding years we have also developed a strong practice in the area of non performing loans, “NPL” and where we advise vendors or purchasers of such portfolios.
We have strong corporate, company commercial and employment teams and our debt collection department handles the collection of debts and enforcement of claims for our clients.
In cross-border matters our clients benefit from our firm’s well established relationships with pre-eminent law firms in foreign jurisdictions, especially in the United States and the UK and our lawyers' own specialist international expertise.
Our work requires for us to work through integrated, multidisciplinary teams. Where appropriate, accounting and tax law know-how is obtained from our close network of accountants, tax advisors, management consultants and interim managers.
